Marriage-based Green Card
If you are a United States citizen or Lawful Permanent Resident looking to apply for your spouse or fiancee’s visa, Liechty Law PLLC would be honored to assist you with this process. If you are married to a non-citizen or planning to do so, we strongly advise getting immigration counsel first. While marriage to the U.S. citizen or lawful permanent resident (LPR) does provide a pathway to residency, it is not without its hurdles. We would be honored to help you plan your immigration strategy with your noncitizen spouse.
Sponsor a Family Member
Are you looking to bring a family member to the United States? We would love to discuss your family’s options with you. Whether your family member has a history of unlawful presence in the United States, a criminal record, previous deportation(s), or other history that you believe would make him or her ineligible for residency, please reach out to discuss your family member’s potential pathways to U.S. residency.
Fiance Visa (K-1)
If you are a U.S. citizen planning to get married to your noncitizen spouse in the United States, then a K-1 Finance Visa may be for you. The K-1 Visa allows a noncitizen fiance to enter the U.S. to marry the U.S. citizen spouse within 90 days. After the marriage, the K-1 holder becomes eligible to adjust status. Adjustment of Status and Consular Processing
Once eligibility for a visa is established and USCIS approves a petition, the visa applicant obtains immigrant status by either adjustment of status, if already present in the United States and obtaining status State side, or consular processing, if the applicant is out of the United States and obtaining the visa from an embassy. Which path you choose depends on a variety of factors such as current immigration status and need to travel out of the United States while the green card is pending. Liechty Law is ready to discuss both options with you and help you decide which path best fits your goals and situation.
Waivers
Accrued unlawful presence, prior removals, and criminal matters can all impact whether someone would be able to access an immigration status he or she otherwise qualifies for.
